Boheme USA E-Commerce Distance Sales Agreement
1. Parties
This agreement is entered into between [Boheme USA], hereinafter referred to as the "Seller", and the customer who accepts this agreement, hereinafter referred to as the "Buyer".
2. Subject of the Agreement
The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of products purchased or to be purchased by the Buyer from the Seller via electronic commerce.
3. Orders
The Buyer is deemed to have accepted this agreement by placing an electronic order through the Seller’s website. Upon receiving the order, the Seller will send a confirmation email to the Buyer containing the details of the order. This confirmation email serves as a notice that the order has been received.
4. Delivery
The Seller will prepare and dispatch the Buyer’s order as soon as possible after receipt. The delivery time may vary depending on the Buyer’s location and the selected shipping company. The Seller will inform the Buyer about the delivery process and ensure delivery is made at the earliest possible time.
5. Price and Payment
The prices of the products are as indicated on the Seller’s website. Payment will be made using the payment method chosen by the Buyer. The Seller will take all necessary precautions to ensure the security of the payment process.
6. Cancellation and Return
The Buyer has the right to cancel or return the products purchased from the Seller within 14 days of delivery without providing any reason and without incurring any penalties. Requests for cancellation or return must be made through the contact information provided on the Seller’s website. In case of cancellation or return, the product must be undamaged, unused, and in its original packaging.
7. Privacy Policy
The Seller undertakes to keep the Buyer’s personal data confidential. The Buyer’s personal information will only be used for order processing and for communication if necessary. For more information, please refer to the Privacy Policy available on the Seller’s website.
8. Dispute Resolution
Turkish laws shall govern the resolution of any disputes arising from this agreement. The parties agree that Istanbul Courts and Enforcement Offices shall have jurisdiction over any disputes that may arise.
This agreement shall enter into force upon electronic confirmation by the parties.
